Karnataka: High court of Karnataka commenced the hearing of the Hijab row on Tuesday. The petition was filed by two female students of government pre-university of Udupi district.
Justice Krishna S, Dixit is hearing the case. He requests advocates to ‘aside passion and emotions, and go by the law, reasons, and the constitution.
Advocate Muhammad Tahir is putting the case for the four girls who filed the petition against the Karnataka government’s order to change the dress code of schools and colleges in Karnataka. The first petition was filed by two girls and the second petition was filed by Aishat Shifa and Thairin Begum from Udupi on February 5 questioning the legality of the Government order on February 5.
The government of Karnataka announced regulations for school uniforms in the state on February 5. The government announced that neither Saffron Dupatta nor Hijab will be worn in Schools.
Advocate Tahir requested HC to allow the four of the students to wear ‘Dupatta as Hijab’ as Dupatta are prescribed by the institution as part of Uniform.
The end of the academic curriculum is two months away while the settlement of the Karnataka Hijab row is pending for now. The Hindu reported Justice Dixit saying that the issue needs to be solved soon as it is not a happy scene to see students marching on roads every day.
Wearing the dress of choice is an extension of the fundamental right to freedom of speech and expression under Article 19 (1)(a).
Times of India reported that the HC suspected some mischievous people trying to keep the issue burning.
The hearing will proceed today at 2:30.
